The plaintiff allegd that the attorney failed to take steps to allow plaintiff to avail itself of benefits of Section 1031 of the Tax Code. In dismissing the case, the court found that plaintiff had failed to prove proximate cause - that but for the defendant's alleged negligence, the plaintiff would have been entitled to benefit from Section 1031.
