The plaintiff sued a homeowners’ community association alleging that it breached a freight carriage agreement and tortiously interfered with the plaintiff’s prospective business relationships. The plaintiff sought damages in excess of one million dollars. The defendant also asserted a counterclaim against the plaintiff for breaching the same agreement. After almost 7 years of litigation, the court granted the defendant’s post-note of issue summary judgment, which dismissed the complaint in its entirety and held that the plaintiff was liable to the defendant on its counterclaim.
