Manu Davidson and Maria Boboris obtained dismissal of three claims asserted by a cooperative shareholder against his cooperative. In the lawsuit, the shareholder alleges that he has a right to replace an air conditioning unit that services his apartment pursuant to a license agreement. The shareholder sued the cooperative for breach of his proprietary lease, breach of the license agreement, tortious interference with prospective business relations, and for a declaratory judgment that he has the right to replace the air-conditioning unit under the license agreement. The court dismissed the shareholder’s claims for breach of the proprietary lease, tortious interference, and for declaratory judgment.
