Manu Davidson Obtains Dismissal of Article 78 Petition on Behalf of NYC Co-op

The petitioner commenced an Article 78 Proceeding by an order to show cause seeking a judgment to overturn two decisions rendered by a residential cooperative’s board of directors.  The first decision denied the petitioner’s application to purchase a second apartment in the building.  The second decision denied the petitioner’s application to add his son to the stock certificate and proprietary lease appurtenant to an apartment that the petitioner already owns in the building.  The court dismissed the petition and denied the order to show cause on the grounds that the petition was time-barred  pursuant to CPLR 217(1).  To view the decision, click here.
