The New York Post reported on Judge Kathryn Freed’s recent decision in Dogwood Residential, LLC v. Stable 49, Ltd., granting the motion made by Tracy Peterson on behalf of the defendant cooperative apartment corporation seeking dismissal of the lawsuit. As reported by the newspaper, Judge Freed noted that the plaintiff penthouse owner could not, on the one hand, have a rotating group of raucous partying tenants living in the apartment for seven-month period and on the other hand, claim that the apartment is somehow “uninhabitable.”
