Peterson, Davidson, and Goljan Secure Dismissal of Several Claims by Shareholders

Tracy Peterson, Manu Davidson, and Joseph Goljan successfully secured dismissal of several claims asserted by two co-op shareholders against a co-op, its board of directors, and individually-named board members. In a lawsuit commenced in New York County Supreme Court, husband and wife co-op shareholders alleged unreasonable delay in the board’s approval of their alteration application for a newly-purchased co-op unit. The Court granted the motion to dismiss ten of the shareholders’ thirteen causes of action, dismissing all claims against the individually-named Board members, as well as the claims seeking equitable relief, punitive damages and damaged for negligence.
