Scott Greenspun and Lauren Piechocki successfully defended against a shareholder’s appeal challenging two decisions rendered in the Supreme Court of the State of New York, New York County. The First Department affirmed the trial court’s determination that there was no justiciable controversy concerning the operation of the co-op’s executive committee because such committee had been disbanded. The Appellate Division also affirmed the trial court’s holding that statements about the litigation in newsletters the board distributed to shareholders were not defamatory.
