In the context of an emergency application addressed to permit performance by parties to a confidential settlement agreement, Tracy Peterson successfully moved for an order voiding two transfers of a condominium apartment unit. The court agreed that the subject apartment was transferred by a party to the settlement agreement in violation of the agreement’s terms, the condominium’s bylaws and a court order. As a result, the court voided the transfer. The court also voided a subsequent transfer of the apartment since the transferee did not have valid title to convey.
