Tracy Peterson Obtains Dismissal of Breach of Fiduciary Duty Claim

In an action by a condominium board of managers alleging that the defendant successor sponsors have defeated the purpose of the condominium by holding and refusing to divest themselves of their holdings of a significant percentage of the condominium’s residential units, Tracy Peterson, on the board’s behalf, obtained dismissal of the successor sponsors’ counterclaim for breach of fiduciary duty by the board and their plea for an award of attorney’s fees.
