Tracy Peterson obtained a landmark decision in a First Department appeal in which at issue was a condominium board of managers’ right to impose fines for violations of house rules when the enumerated powers allocated to the board in the bylaws did not specifically empower the board to levy fines. The First Department held that although the amount of the fines at issue in the case were confiscatory, “the Board’s authority to impose fines is within its power to implement rules and regulations as provided in the by-laws.”
