Tracy Peterson Obtains Relief on Reargument and Successfully Quashes Two Non-Party Subpoeneae and Opposes Motion to Amend

In a decision and order addressing a plaintiff-cooperative shareholder’s motion to reargue portions of prior cross-motions for summary judgment, the plaintiff’s motion to amend his complaint, and the co-op’s cross-motion to reague and the co-op’s separate motion to quash non-party subpoenae, Tracy Peterson, representing the co-op, obtained a substantial victory.  All applications by the plaintiff were successfully defeated, the co-op’s motion to quash was granted in its entirety and the co-op’s cross-motion to reargue afforded it summary judgment on one of the two claims remaining to be litigated.
